en مروری بر اهدای جنین به زوجین نابارور در ایران A Review of Embryo Donation to the Infertile Couples in Iran عمومى General اهدای جنین یکی از فناوری های کمک باروری و یکی از موثرترین راههای درمان زوج های ناباروری است که خود به هیچ وجه قادر به بچه دار شدن نیستند. تصویب قانون نحوه اهدای جنین، اگر چه موضوع انتقال جنین به زوجین نابارور را تا حدی حل نموده و تحولی در حقوق ایران ایجاد کرده است، اما دارای نواقصی است. هدف این مطالعه مروری بر نحوه اهدای جنین به زوجین نابارور در ایران است.  مطالعه حاضر از نوع مرور روایتی است. جستجوی مستندات مرتبط با موضوع پژوهش، بدون محدودیت زمانی و با استفاده از کلیدواژههای ناباروری، روشهای کمک باروری (Assisted Reproductive Technologies)، اهدا، اهدا کننده، اهدا گیرنده، اهدای جنین، قانون، حقوق، قانون اهدای جنین و ایران، به‌ تنهایی یا به‌ صورت ترکیبی در پایگاه‌های اطلاعاتی PubMed، Scopus، Magiran، SID، Google Scholar و وب سایت وزارت بهداشت و درمان و آموزش پزشکی، مرکز پژوهش های مجلس شورای اسلامی، سامانه جامع نظرات شورای نگهبان، معاونت حقوقی و امور مجلس قوه قضاییه و مرکز تحقیقات اخلاق و حقوق پزشکی انجام شد. در سال 1383 قانون نحوه اهدای جنین به زوجین نابارور و آیین نامه اجرایی آن که با استناد به آراء فقها، و متناسب با شرایط جامعه اسلامی بود، به تصویب رسید. البته اهداکنندگان جنین تشکیل شده را اهدا نمی کنند، بلکه با دادن گامت و گذاشتن آن در اختیار مراکز مجاز درمان ناباروری موافقت می کنند و جنین حاصل از آن به زوجینی که شرایط خاصی داشته باشند اهدا می شود. اگر چه قانون نحوه اهدا جنین دارای نواقصی است که بایستی اقداماتی در جهت رفع و اصلاح آنها صورت پذیرد. اما باید اذعان نمود که تصویب این قانون و آیین نامه اجرایی آن از یکی بزرگترین اقداماتی است که در سال های اخیر در ایران صورت گرفته است. هم چنین با توجه به زمینه های شرعی، مذهبی و فرهنگی موجود در جامعه ایران و به دلیل اینکه این نوع اهدا، کم ترین مشکلات شرعی را دارد، توانسته است مشکلات بسیاری از زوجین نابارور را حل نماید.   <div style="text-align: justify;">Embryo donation is an assisted reproductive technology and one of the most effective ways for treating infertile couples who are not able to have children by themselves at all. Although the approval of the law on embryo donation has partially resolved the issue of transferring the embryo to the infertile couples and has revolutionized the laws in Iran, has some drawbacks. This study aims to review the way of donating embryos to infertile couples in Iran. This is a narrative review study. Search for documents related to the research topic were carried out with no time limit and with the use of keywords including infertility, assisted reproductive technologies, donation, donor, recipient, embryo donation, rule, law, embryo donation law, and Iran, singly or in combination at the databases of PubMed, Scopus, Magiran, SID, Google Scholar and department of health and medical education's website, Islamic consultative assembly research center, comprehensive system of constitutional council's comments, legal and parliamentary affairs deputy of the judiciary and medical ethics and law research center. The embryo donation to infertile couples Act and its regulations were legislated by jurisprudence opinions and Islamic community conditions. Indeed, donors don’t donate the formed embryo, but they agree with giving gamete and reposing it to authorized infertility treatment centers, and the embryo formed is donated to the couples with a special condition. Although the embryo donation Act has some flaws that some actions should be taken to eliminate and correct, it should be acknowledged that approval of this Act and its regulations are one of the biggest measures taken in recent years in Iran.
